On May 15th, Billie was in court with her attorneys Hoffman and Piquett. During the lunch recess Billie slipped out with the jurors. She reached the corridor before being caught and brought back in. To Louis's surprise John showed up outside the courthouse the very next day to find out if they were having any luck getting Billie off. It was too soon to tell at the time.

After several weeks the jury finally returns with its verdict on May 23. Despite all efforts in her defense she was convicted and given a fine of $1,000 and a sentence of 2 years in the federal prison in Milan, Michigan.

Dillinger paid the fine but Piquett not wanting to announce his connection with the man claimed Billie's sister Patsy came up with the money. An appeal was filed but for some reason ended up in Denver, Colorado. The clerk there told Hoffman they were so backed up that it might be as long as 6 months before they got to it.
